Summary of Law:

It is unlawful for any person under the age of twenty-one years (21) to possess, consume, or otherwise acquire any liquor.  It is also unlawful for a person under the age of twenty-one years (21) to be in a public place, or to be in a motor vehicle in a public place, while exhibiting the effects of having consumed liquor.  Washington law defines exhibiting the effects of having consumed liquor as a person having the odor of liquor on his or her breath and either: (a) Is in possession of or close proximity to a container that has or recently had liquor in it; or (b) by speech, manner, appearance, behavior, lack of coordination, or otherwise, exhibits that he or she is under the influence of liquor.

Any person who violates the above these laws commit a gross misdemeanor.


Every person under the age of eighteen (18) convicted of a gross misdemeanor will face “local sanctions” in juvenile court, which consist of the following: (a) 0-30 days of confinement; (b) 0-12 months of community supervision; (c) 0-150 hours of community restitution; and/or (d) $0-$500 fine.

Every person over the age of eighteen (18) convicted of a gross misdemeanor will face imprisonment in a county jail as ordered by the court with a maximum of three hundred sixty-four days and/or a fine in an amount fixed by the court of not more than five thousand dollars ($5000).
